MobKit 最终用户许可协议

本协议是您（个人或单一实体，下称「您」）与 MobKit 团队（下称「许可方」）之间，就 MobKit 软件——包括 JetBrains 插件、VS Code 扩展、命令行工具、MCP 服务器及其相关组件、文档与更新（下称「软件」）——达成的具有法律约束力的协议。

安装、复制或以其他方式使用软件，即表示您已阅读、理解并同意受本协议约束。 如不同意本协议的任何条款，请勿安装或使用软件，并删除已获得的全部副本。

1. 许可授予

在您遵守本协议的前提下，许可方授予您一项非独占、不可转让、不可再许可、可撤销的许可，允许您为内部业务或个人开发目的，在您拥有或控制的设备上安装并使用通过 JetBrains Marketplace、Visual Studio Marketplace 等官方渠道获取的软件副本。软件目前免费提供；许可方保留未来调整分发与授权方式的权利，该等调整不影响您已安装版本在本协议下的使用。

除本协议明确允许或适用法律强制允许外，您不得：

软件系许可使用而非出售。软件及其全部知识产权归许可方及其许可人所有，本协议未明示授予的一切权利均予保留。软件中包含的第三方开源组件按其各自的开源许可证条款提供并受其约束，该等组件的许可声明随软件分发，或可向许可方索取。

4. 第三方服务

软件可连接第三方服务（包括但不限于用友云服务，以及 JetBrains、Microsoft 运营的插件市场）。您使用第三方服务须遵守其各自的服务条款，许可方对第三方服务的可用性、准确性或内容不承担责任。您用于登录第三方服务的凭据与会话信息仅保存在您本机 IDE 提供的安全存储（如 Secret Storage / Password Safe）中，由您自行管理与清除。

5. 隐私与数据

软件本身不会向许可方收集或上传您的源代码、账号凭据或个人数据。WiFi 真机同步功能仅在您的本地局域网内传输数据。软件与第三方服务（如用友云）之间的数据传输，以完成您主动发起的操作（如登录、应用检出、上传）所必需者为限。

6. 更新与协议变更

许可方可不时发布软件更新，更新可能经由插件市场自动安装。除非更新另附条款，本协议同样适用于更新后的软件。许可方可修订本协议，修订版本自发布后对您新安装或继续使用的软件版本生效。

7. 免责声明

在适用法律允许的最大范围内，软件按「现状」及「可用」状态提供，许可方不作任何明示、默示或法定的担保或条件，包括但不限于对适销性、特定用途适用性、无病毒及不侵权的默示担保。您因使用软件产生的风险由您自行承担。

8. 责任限制

在适用法律允许的最大范围内，许可方不对任何间接、附带、特殊、惩罚性或后果性损害（包括利润损失、数据丢失或业务中断）承担责任，即使已被告知发生该等损害的可能性。许可方就本协议及软件承担的全部责任，以您为软件实际支付的费用（如有）与人民币 100 元中较高者为限。适用法律不允许排除或限制的责任，不受本条影响。

9. 终止

如您违反本协议任何条款，本许可自动终止，无需许可方另行通知。终止后，您应立即停止使用软件并删除全部副本。第 3、7、8、10 条在本协议终止后继续有效。

10. 适用法律与争议解决

本协议受中华人民共和国法律管辖（不适用其冲突法规则）。因本协议引起的或与之相关的争议，双方应友好协商解决；协商不成的，任何一方均可向许可方所在地有管辖权的人民法院提起诉讼。

11. 其他

本协议构成双方就软件达成的完整协议。本协议任何条款被认定无效或不可执行的，不影响其余条款的效力。许可方未行使或迟延行使本协议项下权利，不构成对该权利的放弃。

MobKit End User License Agreement (EULA)

This English translation is provided for convenience only. In case of any discrepancy, the Chinese version above shall prevail.

This Agreement is a legally binding agreement between you (an individual or a single entity, "You") and the MobKit team (the "Licensor") regarding the MobKit software — including the JetBrains plugin, the VS Code extension, the command-line tool, the MCP server, and their related components, documentation, and updates (the "Software"). By installing, copying, or otherwise using the Software, You agree to be bound by this Agreement. If You do not agree, do not install or use the Software, and delete all copies in Your possession.

1. License Grant

Subject to Your compliance with this Agreement, the Licensor grants You a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use copies of the Software obtained through official channels (JetBrains Marketplace, Visual Studio Marketplace) on devices You own or control, for Your internal business or personal development purposes. The Software is currently provided free of charge; the Licensor reserves the right to change its distribution and licensing model in the future, without affecting Your use of already-installed versions under this Agreement.

2. License Restrictions

Except as expressly permitted by this Agreement or mandated by applicable law, You shall not: (a) copy (other than reasonable archival backups), distribute, sell, rent, lease, lend, sublicense, or provide the Software to third parties as a hosted service; (b) reverse engineer, decompile, or disassemble the Software, or otherwise attempt to derive its source code, except to the extent such restriction is prohibited by applicable law; (c) modify the Software or create derivative works of it; (d) remove, obscure, or alter any copyright, trademark, or other proprietary notices; (e) use the Software in violation of applicable laws or regulations.

3. Intellectual Property

The Software is licensed, not sold. The Software and all intellectual property rights therein are owned by the Licensor and its licensors; all rights not expressly granted are reserved. Third-party open-source components included in the Software are provided under, and governed by, their respective open-source licenses; the corresponding notices are distributed with the Software or available from the Licensor upon request.

4. Third-Party Services

The Software may connect to third-party services, including but not limited to Yonyou cloud services and the plugin marketplaces operated by JetBrains and Microsoft. Your use of third-party services is governed by their respective terms; the Licensor is not responsible for the availability, accuracy, or content of third-party services. Credentials and session data You use to sign in to third-party services are stored only in the secure storage provided by Your local IDE (e.g., Secret Storage / Password Safe) and are managed and cleared by You.

5. Privacy and Data

The Software itself does not collect or upload Your source code, account credentials, or personal data to the Licensor. The WiFi device-sync feature transfers data only within Your local network. Data exchanged between the Software and third-party services (such as Yonyou cloud) is limited to what is necessary to complete operations You initiate (such as sign-in, app checkout, and upload).

6. Updates and Changes to This Agreement

The Licensor may release updates to the Software, which may be installed automatically via the marketplaces. Unless an update is accompanied by separate terms, this Agreement applies to the updated Software. The Licensor may revise this Agreement; revised versions take effect for versions of the Software You newly install or continue to use after publication.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Software is provided "AS IS" and "AS AVAILABLE", without warranties or conditions of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, freedom from viruses, and non-infringement. You bear all risk arising from Your use of the Software.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, loss of data, or business interruption), even if advised of the possibility of such damages. The Licensor's total liability under this Agreement and in connection with the Software shall not exceed the greater of the amount You actually paid for the Software (if any) and RMB 100. Nothing in this section limits liability that cannot be excluded or limited under applicable law.

9. Termination

This license terminates automatically, without notice from the Licensor, if You breach any term of this Agreement. Upon termination, You must immediately cease using the Software and delete all copies. Sections 3, 7, 8, and 10 survive termination.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. Disputes arising out of or relating to this Agreement shall first be resolved through friendly negotiation; failing that, either party may bring the dispute before a competent people's court at the Licensor's place of domicile.

11. Miscellaneous

This Agreement constitutes the entire agreement between the parties concerning the Software. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Failure or delay by the Licensor in exercising any right under this Agreement does not constitute a waiver of that right.
